By accessing or using the Website, you agree to be bound by these TOU and our Privacy Policy , which is incorporated herein by reference. If you do not agree with all of these TOU, you are expressly prohibited from using the Website and you must discontinue use immediately. 

The Website may be accessed and used only by individuals who can form legally binding contracts under applicable laws, who are of legal age of majority in the place of residence. By accessing and using the Website, you represent and warrant that you have full power and authority to enter into this Agreement. 

Mammut shall have the right, at any time, to change or modify the TOU applicable to your use of the Website or any part thereof. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on the Website and updating the “Last updated” date of these TOU. The most current version of the TOU can be reviewed by clicking on the "Website Terms of Use" hypertext link located at the bottom of Mammut’s Website. 

Any use of the Website by you after such notice shall be deemed to constitute your acceptance of such changes, modifications or additions, as it is your responsibility to periodically review these TOU to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised TOU by your continued use of the Website after the date such revised TOU are posted.

If any of the Services requires you to have an account, you must complete the registration process by providing Mammut with current, complete and accurate information as prompted by the applicable registration form. You will also choose a password and a username. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Mammut immediately of any unauthorized use of your account or any other breach of security. Mammut will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Mammut or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.  

You shall use the Website for lawful purposes only. You shall not post or transmit through the Website any material which violates or infringes in any way the rights of others, that are unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, or that gives rise to civil liability. Any conduct by you that, in Mammut's discretion, restricts or inhibits any other individual from using or enjoying the Website will not be permitted. You shall not use the Website to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of individuals to become subscribers of other on-line information services competitive with Mammut. 

Some of the Services may have chat, live support, or similar functionality to serve you better (“Chat”). You should review our Privacy Policy  to learn how we treat information that could identify you that was gathered via a Chat. If you are signed into an Account while using a Chat, the Chat may link the Account information with you or the Chat interaction. You may not impersonate or attempt to gain information regarding another individual via a Chat. Information provided via a Chat may be inaccurate, and Chats may not always be available or error-free. Chats may be provided by third parties. 

The Services may contain email services, newsletter services, chat areas, news groups, forums, communities, personal web pages, calendars, photo albums, file cabinets and/or other message or communication facilities designed to enable you to communicate with others. 5. Use any material or information, including images or photographs, which are made available through the Services in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party.  

6. Upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another.  

7. Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Services specifically allows such messages.  

8. Download any file posted by others of a Service that you know, or reasonably should know, cannot be legally reproduced, displayed, performed, and/or distributed in such manner.  

9. Falsify or delete any copyright management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.  

10. Restrict or inhibit any other from using and enjoying the Services.  

11. Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.

14. Create a false identity for the purpose of misleading others.  

Mammut has no obligation to monitor the Services. However, Mammut reserves the right to review materials posted to the Services and to remove any materials in its sole discretion. Mammut reserves the right to terminate your access to any or all of the Services at any time, without notice, for any reason whatsoever. Mammut reserves the right at all times to disclose any information as it deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Mammut's sole discretion.  Materials uploaded to the Services may be subject to posted limitations on usage, reproduction and/or dissemination; You are responsible for adhering to such limitations if you downloads the materials.  You must always be caution when giving out any personally identifiable information in any Services. Mammut does not control or endorse the content, messages or information found in any Services and, therefore, Mammut specifically disclaims any liability with regard to the Services and any actions resulting from your participation in any Communication Services. Managers and hosts are not authorized Mammut spokespersons, and their views do not necessarily reflect those of Mammut.

The Website contains copyrighted material, trademarks and other proprietary information, including, but not limited to, names, logos, text, designs, graphics, trade dress, characters, interfaces, code, software, images, sounds, videos, photographs, and other content appearing in or on the Services (“Content”). Mammut owns a copyright in the selection, coordination, arrangement and enhancement of such Content, as well as in the content original to it. You may not modify, publish, transmit, and participate in the transfer or sale, create derivative works, or in any way exploit, any of the Content, in whole or in part. You may download copyrighted material for your personal use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express written permission of Mammut and the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. You acknowledge that you do not acquire any ownership rights by downloading copyrighted material.  

You shall be responsible for obtaining and maintaining all telephone, computer hardware, software and other equipment needed to access and use the Website and all charges related thereto.

The Software is being provided to you by Mammut pursuant to the following terms: Mammut grants you a non-exclusive, non-transferable, limited license to use the Software only for the purpose of using the Website. Except as specifically provided in these TOU, you may not, in whole or in part: (a) copy the Software, (b) distribute copies of the Software, in whole or in part, to any third party; (c) modify, adapt, translate, reverse engineer, make alterations, decompile, disassemble or make derivative works based on the Software, except as otherwise permitted by law; (d) use, rent, loan, sub-license, lease, distribute or attempt to grant other rights to the Software to third parties; or (e) use the Software to act as a service bureau or application service provider, or to permit access to the Software by any third party. Part of the Software may be provided by and/or owned by third parties. 

You may not use any software, robot, crawler, spider, page scraper or any other automated means or device to (a) access, copy, affect or monitor any part of the Website or its content or circumvent the structure or presentation of the Website or any of its content or (b) to interfere with the operation of the Website or any transaction being made on the Website or interfere or affect any person's use of the Website or to help facilitate any third party to purchase any product on the Website.  

You may not attempt to gain unauthorized access to any part or feature of the Website or any system connected to the Website by hacking, password mining or other illegitimate or unauthorized means.  

IN NO EVENT SHALL MAMMUT AND/OR ITS RESPECTIVE SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF SOFTWARE, DOCUMENTS, PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR INFORMATION AVAILABLE FROM THE SERVICES.  

You shall not upload, post or otherwise make available on the Website any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with you. You shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of the Website, you automatically grant, or warrants that the owner of such material has expressly granted Mammut the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. You also permit any other individual to access, view, store or reproduce the material for that individual personal use. You hereby grant Mammut the right to edit, copy, publish and distribute any material made available on the Website by you. 

Mammut does not claim ownership of the materials you provide to Mammut (including feedback and reviews) or post, upload, input or submit to any Services or its associated services for review by the general public, or by the members of any public or private community, (each a "Submission" and collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting ("Posting") your Submission, you are granting Mammut, its subsidiaries companies and necessary sublicensees, permission to use your Submission in connection with the operation of their Internet businesses, including, without limitation, the license rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; to publish your name in connection with your  Submission; and the right to sublicense such rights to any supplier of the Services.  

No compensation will be paid with respect to the use of your Submission, as provided herein. Mammut is under no obligation to post or use any Submission you may provide and Mammut may remove any Submission at any time in its sole discretion. By Posting a Submission you warrant and represent to own or otherwise control all of the rights to your Submission as described in these TOU, including, but not limited to, all the rights necessary for you to provide, post, upload, input or submit the Submissions.  

In addition to the warranty and representation set forth above, by Posting a Submission that contain images, photographs, pictures or that are otherwise graphical in whole or in part ("Images"), you warrant and represent that:  

1. You are the copyright owner of such Images, or that the copyright owner of such Images has granted you permission to use such Images or any content and/or images contained in such Images consistent with the manner and purpose of your use and as otherwise permitted by these TOU. 

2. You have the rights necessary to grant the licenses and sublicenses described in these TOU. 

3. Each person depicted in such Images, if any, has provided consent to the use of the Images as set forth in these TOU, including, by way of example, and not as a limitation, the distribution, public display and reproduction of such Images.  

By Posting Images, you are granting: 

1. to all members of your private community (for each such Images available to members of such private community). 

2. to the general public (for each such Images available anywhere on the Services, other than a private community), permission to use your Images in connection with the use, as permitted by these TOU, of any of the Services, (including, by way of example, and not as a limitation, making prints and gift items which include such Images), and including, without limitation, a non-exclusive, world-wide, royalty-free license to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Images without having your name attached to such Images, and the right to sublicense such rights to any supplier of the Services. The licenses granted in the preceding sentences for a Images will terminate at the time you completely remove such Images from the Services, provided that, such termination shall not affect any licenses granted in connection with such Images prior to the time you completely remove such Images. No compensation will be paid with respect to the use of your Images. 

YOU EXPRESSLY AGREE THAT USE OF THE WEBSITE IS AT YOUR SOLE RISK. NEITHER MAMMUT, ITS SUBSIDIARIES NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE WEBSITE, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH THE WEBSITE.  

THE WEBSITE IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.  

THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. YOU SPECIFICALLY ACKNOWLEDGES THAT MAMMUT IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHERS USING THE WEBSITE OR THIRD PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH YOU.  

IN NO EVENT WILL MAMMNUT, OR ANY PERSON OR ENTITY INVOLVED IN CREATING, PRODUCING OR DISTRIBUTING THE WEBSITE OR THE WEBSITE SOFTWARE, BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE WEBSITE. YOU HEREBY ACKNOWLEDGES THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL CONTENT ON THE WEBSITE.  

IN ADDITION TO THE TERMS SET FORTH ABOVE, NEITHER MAMMUT NOR ITS SUBSIDIARIES, INFORMATION PROVIDERS OR CONTENT PARTNERS SHALL BE LIABLE REGARDLESS OF THE CAUSE OR DURATION, FOR ANY ERRORS, INACCURACIES, OMISSIONS, OR OTHER DEFECTS IN, OR UNTIMELINESS OR UNAUTHENTICITY OF, THE INFORMATION CONTAINED WITHIN THE WEBSITE, OR FOR ANY DELAY OR INTERRUPTION IN THE TRANSMISSION THEREOF TO YOU, OR FOR ANY CLAIMS OR LOSSES ARISING THEREFROM OR OCCASIONED THEREBY. MAMMUT WILL NOT BE RESPONSIBLE FOR ANY FAILURE OR DELAY IN PERFORMANCE DUE TO CIRCUMSTANCES BEYOND ITS REASONABLE CONTROL, INCLUDING, WITHOUT LIMITATION, ACTS OF GOD, WAR, RIOT, EMBARGOES, ACTS OF CIVIL OR MILITARY AUTHORITIES, FIRE, FLOODS, ACCIDENTS, SERVICE OUTAGES RESULTING FROM EQUIPMENT AND/OR SOFTWARE FAILURE AND/OR TELECOMMUNICATIONS FAILURES, POWER FAILURES, NETWORK FAILURES, FAILURES OF THIRD PARTY SERVICE PROVIDERS (INCLUDING PROVIDERS OF INTERNET SERVICES AND TELECOMMUNICATIONS)..

We provide such links for your reference and convenience only. A link from Mammut to a third-party Website does not imply or mean that we endorse the content on that third-party Website or the operator or operations of that third-party Website. You are solely responsible for determining the extent to which you use any content at any third-party Website to which you might link from Mammut. 

MAMMUT IS ALSO NOT RESPONSIBLE OR LIABLE FOR ANY LOSS OR DAMAGES INCURRED AS A RESULT OF ANY DEALINGS WITH ANY THIRD-PARTY WEBSITE, ANY MERCHANT OR OPERATOR OF A THIRD-PARTY WEBSITE, OR ANY OTHER PERSON WITH WHOM YOU ENGAGE IN ANY TRANSACTION. 

Mammut shall have the right, but not the obligation, to monitor the content of the Website, including chat rooms and forums, to determine compliance with this Agreement and any operating rules established by Mammut and to satisfy any law, regulation or authorized government request. Mammut shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted on the Website. Without limiting the foregoing, Mammut shall have the right to remove any material that Mammut, in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.  

You agree to indemnify and hold Mammut, its directors, officers, employees, agents and subsidiaries harmless from any and all claims, liabilities, damages, costs and expenses, including reasonable attorneys' fees, in any way arising from, related to or in connection with your (including your dependents’ or agents’) violation of these TOU or the posting or transmission of any materials on or through the Website by you, including, but not limited to, any third party claim that any information or materials you provide infringes any third party proprietary right. 

Either Mammut or you may terminate this Agreement at any time. Without limiting the foregoing, Mammut shall have the right to immediately terminate your Account in the event of any conduct by you which Mammut, in its sole discretion, considers to be unacceptable, or in the event of any breach of this Agreement by you.  

The courts of the city in which Mammut has its seat will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to the Website, although Mammut retains the right to bring proceedings against you for breach of these TOU in your country of residence or any other relevant country. These TOU and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the seat of Mammut. 

These TOU and any policies or operating rules posted by Mammut on the Website or in respect to the Website constitute the entire agreement and understanding between you and Mammut. Our failure to exercise or enforce any right or provision of these TOU shall not operate as a waiver of such right or provision. These TOU operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these TOU is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these TOU and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and Mammut as a result of these TOU or use of the Website.
